A formerly homeless, disabled Veteran is facing imminent eviction through a retaliatory 3-Day Notice to Perform Covenant or Quit. This notice is unlawful and must be immediately rescinded, withdrawn, and vacated. Mr. Robert Canas, a disabled Veteran residing at Building 205, 700 Bonsall Avenue, Los Angeles, received a 3-Day Notice dated February 5, 2026. This eviction is not based on any legitimate lease violation. It is retaliation for protected activity involving the documentation and reporting of life-threatening habitability and safety violations at federally deed-restricted Veterans Soldiers Home, West Los Angeles VA.
This correspondence serves as formal notice and demand for immediate corrective action regarding Building 205 Preservation, L.P. and the conditions and retaliatory conduct occurring at the 700 Bonsall Avenue. This notice is directed to The John Stewart Company, Anthony Ramirez Vice President and Disability Coordinator, Katia Diarte Regional Manager, Nikki Santos Senior Property Manager, Delandra Santos On-Site Property and Resident Manager, Building 205 Preservation, L.P., Sally R. Hammitt Interim Deputy Medical Center Director VA Greater Los Angeles Healthcare System, and Andrew Strain Homeless Planning and Homeless Programs Representative affiliated with VA Greater Los Angeles.
The Enhanced Use Lease governing this federally deed-restricted Veterans Soldiers Home is illegal and is being operated in violation of its stated purpose and federal requirements. This property is designated exclusively to serve as a Soldiers Home providing safe supportive residence for formerly homeless and disabled Veterans. Instead, it has been allowed to deteriorate into an environment of unchecked criminal activity, severe habitability violations, and retaliatory enforcement against residents who report these conditions.
The failure of property management and responsible oversight authorities to intervene, investigate or remediate documented conditions at the Soldiers Home has directly allowed illegal activity and dangerous living conditions to exacerbate and proliferate. These include severe and ongoing cockroach infestations, mold and moisture intrusion, rampant drug activity including needles and crack pipes broken, unsecured entry points, lack of adequate case management and resident support and evidence of human trafficking occurring on site. These conditions have been repeatedly documented through photographs, videos, written grievances and direct reports. Their persistence and worsening are the result of inaction not ignorance.
Rather than correcting these violations management has chosen retaliation. The issuance of the February 5 2026 3-Day Notice against Mr. Canas is a transparent attempt to silence a resident advocate who has exposed conditions that endanger lives at the Soldiers Home. Advocacy documentation and reporting have been mischaracterized as harassment and interference. The notice was posted publicly on Mr. Canas’s door face up exposing private allegations to passersby and evidencing intent to intimidate and humiliate.
Mr. Canas is a disabled formerly homeless Veteran in recovery who has worked to maintain sobriety and stability. He has filed formal complaints regarding the above stated conditions taking place at the Soldiers Home. The response from management particularly Property Manager Nikki has included racial slurs, false police reports used to intimidate and escalate harassment. Recording interactions to preserve evidence has been reframed as misconduct. This pattern constitutes unlawful retaliation.
Mr. Canas is the same individual who was previously assaulted, battered, and subjected to an attempted robbery on video by Jim Mathers, CEO of Century Housing, while Mr. Canas was lawfully present at the West Los Angeles Veterans Soldiers Home. That incident was witnessed, recorded, and reported. The fact that Mr. Canas is now facing retaliatory eviction after reporting both violent criminal conduct by a senior housing executive and ongoing life-threatening conditions at the Soldiers Home raises grave concerns about coordinated retaliation, witness intimidation, and abuse of authority. This history is directly relevant to the credibility of Mr. Canas, the motive behind the current eviction attempt, and the urgent need for independent oversight and intervention.
These actions and failures violate the deed to the Soldiers’ Home, the West LA Leasing Act, the federal fair housing laws including 42 U.S.C. § 3617 disability protections under the Fair Housing Act and the Americans with Disabilities Act California Civil Code § 1942.5 prohibiting retaliatory eviction for reporting habitability violations HUD requirements governing Section 42 Low Income Housing Tax Credits and the fundamental obligations of the Enhanced Use Lease governing federally deed-restricted Veterans Soldiers Home. The ongoing deaths and conditions raise serious concerns regarding the implied warranty of habitability and potential negligence.
Immediate relief is required. Mr. Canas has three business days from February 5, 2026 to comply with demands that effectively require him to cease protected advocacy or face homelessness. This eviction must not proceed.
Demands are as follows. The retaliatory 3-Day Notice issued to Mr. Robert Canas must be immediately rescinded withdrawn and vacated. All retaliatory conduct against Mr. Canas and other resident advocates at the Soldiers Home must cease. Immediate corrective action must be taken to address health safety and security violations at the Soldiers Home. All records communications complaints, maintenance logs surveillance and internal correspondence must be preserved. This issue will be escalated to HUD, the VA Office of Inspector General, fair housing enforcement agencies, and additional federal, and state oversight bodies.
Mr. Canas possesses extensive documentation including photographs, videos, written grievances, and a detailed timeline and is prepared to cooperate fully with any investigation. What is required now is decisive intervention to prevent homelessness preserve evidence and stop further harm at this federally designated Soldiers Home.
