Driving under the influence is dangerous and continues to cause serious harm. According to national traffic safety data, alcohol-impaired driving is involved in roughly one out of every three traffic fatalities in the United States, resulting in more than 10,000 deaths each year. Under the First Amendment, individuals generally have the right to record police officers performing their duties in public spaces, so long as it does not interfere with their work. Under the Fourth Amendment, individuals have the right to refuse consent to searches. Under the Fifth Amendment, individuals have the right to remain silent, but this right must be clearly invoked. A commonly used invocation is: “I am exercising my right to remain silent and I want to speak with a lawyer.”
